Acceptance of Terms

By accessing or using the website at westervilledeckandfence.com (the "Site") or by requesting, scheduling, or receiving services from Westerville Deck & Fence ("we," "us," or "our"), you agree to these Terms and Conditions in full. Description of Services

Westerville Deck & Fence provides residential deck building, fence installation, and related outdoor construction services in Westerville, OH and the surrounding Columbus metro area. Our services include but are not limited to custom deck design and build, composite deck installation, wood deck construction, deck repair and replacement, deck staining and sealing, vinyl and wood fence installation, pergola installation, screened-in porches, covered decks, and related outdoor structures.

All services are subject to availability, site conditions, permitting requirements, and agreement on scope and price prior to commencement of work. We reserve the right to decline any project at our discretion.

Estimates and Pricing

Any estimate or quote provided by Westerville Deck & Fence is based on information available at the time of the estimate and the scope of work described during the consultation. Estimates are not binding contracts and are subject to change based on:

• Changes in the scope of work requested by the customer
• Unforeseen site conditions discovered during the project
• Changes in material costs between estimate and project start
• Permit or inspection requirements that were not apparent at the time of estimate

A written contract specifying the agreed scope, price, timeline, and payment terms will be provided before any work begins. Work does not commence until both parties have signed the written agreement.

Scheduling and Cancellation

Project start dates are estimated at the time of contract signing and may be affected by weather, permit approval timelines, material availability, and prior project completion. We will communicate any significant schedule changes as early as possible.

If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellation terms - including any deposit refund conditions - are specified in the written contract for your project. In general:

• Cancellations made before materials are ordered may be eligible for a full deposit refund, subject to the specific contract terms.
• Cancellations made after materials have been ordered or work has begun will be subject to costs incurred up to the date of cancellation.

Payment Terms

Payment terms are specified in each written project contract. In general:

• A deposit is typically required to secure your project start date and cover initial material costs.
• Progress payments may be required at agreed milestones for larger projects.
• Final payment is due upon project completion and your acceptance of the finished work.

Balances not paid by the due date specified in the contract may be subject to a late fee as outlined in that agreement. We accept payment by cash, check, or other methods specified in your contract. We do not retain payment card information.

Customer Responsibilities

As a customer, you are responsible for:

• Providing accurate information about your property, existing structures, and any known site conditions during the estimate and design process.
• Disclosing any homeowners association (HOA) rules or deed restrictions that may affect the design or placement of the work.
• Ensuring that property lines are accurately known and providing that information if requested.
• Keeping the work area clear of people and pets during construction.
• Obtaining any HOA approvals required separately from the city permit, unless otherwise agreed in writing.

Permits and Compliance

Unless otherwise specified in writing, Westerville Deck & Fence will obtain the necessary building permits from the applicable local authority for covered projects. Permit fees may be included in or added to the project price as specified in the written contract. We build to applicable local building codes. Changes to the scope of work that affect code compliance or require amended permits will be documented and agreed upon in writing before proceeding.

Warranty

Our workmanship warranty terms are specified in each written project contract. In general:

• We warrant that our work will be completed in a professional manner and in accordance with the agreed scope and applicable building codes.
• Materials are subject to the manufacturer's warranty, which we will pass through to you where applicable. We do not extend the manufacturer's warranty beyond its original terms.
• Warranty claims require written notice to us within the warranty period. Warranty does not cover damage from misuse, neglect, acts of nature, or modifications made by others.

Except as stated in the written project contract, all services are provided "as is" and we make no other express or implied warranties regarding merchantability or fitness for a particular purpose beyond what is required by applicable law.

Limitation of Liability

To the fullest extent permitted by law, Westerville Deck & Fence shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services we provide or the use of our Site.

Our total liability to you for any claim arising out of a specific project shall not exceed the total amount you paid us for that project. Some states do not allow limitations on certain implied warranties or exclusions of certain damages, so some of the above limitations may not apply to you.

Website Use

The content on our Site is provided for general informational purposes only. While we make reasonable efforts to keep the information accurate and up to date, we make no warranties about the completeness, accuracy, or suitability of the information on the Site.

Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts located in Ohio.
